A respected middle school band teacher already facing two counts of first-degree sex abuse was indicted Friday on 13 additional sex-related charges.
Joe Billera, 30, pleaded innocent to all 15 counts in Marion County Circuit Court. The charges involve allegations from four former female students. The counts include second-degree rape, first- and second-degree sex abuse, second-degree sodomy and one count of endangering the welfare of a minor.
Billera, a band teacher at Houck Middle School, was arrested Oct. 29 by Salem police on two counts of first-degree sex abuse in connection with allegations that he inappropriately touched a former female student who is now 17.
The new charges involve allegations from three other former female students, said Darin Tweedt, a Marion County assistant district attorney. Two of the students now are 15 and 17 years old and still in high school. The third is 18 or older and no longer in school.
Billera?s arrest stemmed from an investigation that police began Oct. 29 when a former student filed a complaint. Following his arrest, police continued to investigate, and a Marion County grand jury indicted Billera last week on the additional charges. The charges involve incidents that allegedly occurred between June 1998 and July 2002.
Billera remains in the Marion County jail without bail.
Tweedt said the child endangerment charge is in relation to an alleged incident between January and July 2002 in which Billera allowed his son, who was younger than 5, to witness a sexual act.
Paul Ferder, Billera?s attorney, defended his client Friday.
?I think there?s more that will come out that won?t paint him as a bad guy,? Ferder said. ?He?s a really nice guy and a good teacher.?
Salem police said the allegations related to sexual misconduct are the most against a teacher in the Salem-Keizer School District in at least 12 years. Billera?s case, however, differs from other high-profile sex abuse cases in the school district because the alleged incidents are thought to have occurred during several years.
In 1991, a teacher?s aide at Highland Elementary School was charged with 13 counts of sex abuse on allegations that he fondled at least 13 first-grade girls during a six-month period. Carlos Antonio Caceres was convicted in January 1992 on seven counts of first-degree sex abuse and sentenced to nearly four years in prison.
In 1992, another teacher?s aide at Highland was charged with 10 counts of first-degree sexual abuse for allegedly fondling multiple students during a six-month period. Anthony Kendall Dewater fled the area later that year and still is wanted by authorities.
Since 1992, Salem police have not investigated any cases involving allegations of sexual misconduct involving multiple students.
Salem-Keizer School District Superintendent Kay Baker said Billera remains on paid administrative leave.
?We?ll continue to evaluate the situation and make changes in that as it becomes necessary. The investigation first starts with the police. We will wait for that until the district does its own.?
The Statesman Journal has asked to review Billera?s personnel records and any previous complaints that may have been filed against him. The school district has denied the newspaper?s request, citing confidentiality rules.
After Billera?s arrest, Baker sent a report on the matter to the Oregon Teacher Standards and Practices Commission, said Melody Hanson, executive assistant at the commission.
No action will be taken on the report until the outcome of Billera?s criminal charges is determined, Hanson said.

I went to Houck middle School when mr. Billera taught band there, He seemed like the coolest teacher ever... he was my favorite. When I found out what he did I was totally shocked! It made me think, That there were times when I was alone with him after school in his office. He could have raped me or something... EWWWW! he diserves what he is getting!

To Stacey Lambert: I am the new band instructor at North Salem High. I knew Joe Billera. He was a good friend of mine. Because of what happened to you Miss Lambert you have decided not to participate in the High school band program. It is unfortunate that you have to hide from your own mistakes and run away from your talents. Did you forget that you are the one who stayed after class? I have to say that he manipulated me and he does not deserve any sympathy....what he did to me and other CHILDREN is that of what a predator does to his prey. He new exactly what he was doing and took thte time to find the moste insecure children to take advantage of...this happened over a course of years..meaning he was patient with his evil doing and contemplated his next victim...he is a demon in human form and needs to go back home!

Yeah he was my band teacher for 4 years too i knew the guy real well, but not as well as i might have thought, i dated (a year bfore all this happened) and was very close to one of the girls whos lifes he helped ruin, the guy was great with words so i can see how he could pull it off so i always had my doubts about him, i was also singled out by him because he always had something against me now i know what that was. He was a great teacher but a horrible person and I'm glade that PERP is where he belongs, Mr B i hope you get to read this i know you know my name real well, good luck in the pen bud.

Mr.billera was my band teacher for 4 years. I never would have guessed that he would do such a thing. I trusted him. When I had a problem with school or something he would always try and help me. What he did was wrong but weren't the girls consenting? I mean, what were they doing at his house in the first place? Mr. Billera was a great teacher and I would still let him be my teacher because he isn't all bad. It's not like he ever tried anything with me.

To the person who wrote all of the "shut up, you're dumb" comments, you mentioned that people care more about events that happen close to home. Isn't that true about all people, including yourself? Wouldn't you be more upset if your house burned down that if someone 2000 miles away lost their house to a fire? It just makes sense. And your comment "you don't know him or the girls" is pretty stupid. How about shut up, YOU'RE dumb. A lot of people know Joe and the girls, and love them too, so it's a very painful event for all who do. Even for people who don't know them well, they can and do feel sypathy for them. You sound like a very angry person and I'm just curious if you are a student or an adult, male or female, or whether you have ever been a victim yourself for you to be such an authority on the matter.

Yes, it's true that children were married at a young age years ago, but times have changed since then. There have been scientific studies that have shown that just as the body developes gradually, so does the brain. For example, you can't teach an infant to do long division. Their brains just are not developed enough to comprehend such a concept. It has been shown that a human brain is not fully developed until the late teens. Some teens may seem mature, but the fact remains that their brains are not fully able to comprehend the emotional consequences to a physical action. Therefore it is up to the adults to guide and protect those children who have not yet reached that level of decision making skill. If exposed to an adult senario before they are ready, they can and usually are terribly scarred. Trust issues infiltrate their entire lives...forever. I am speaking from personal experience. It has far reaching effects. Those adults that take advantage of the emotionally naive don't really love the children that they abuse. They just manipulate them into believing that they do so they can get what they want. When a child grows up and eventually learns what love really means, the damage has already been done. They suddenly learn the difference, and the pain of the abuse lingers in every aspect of their lives.

I also went to high school with Joe, and was good friends with his older sister. A member of the color guard, a member of the Argonauts...I spent three years in school with Joe. When I learned about what Joe had done I was very shocked and dismayed. I could hardly believe that someone I knew so well as a youth could grow up to do what he has done. As a professional working with children, as I do myself....it I just cannot imagine what a 24 year old man (now 30) who had EVERYTHING going for him was thinking. No matter what a 12 year old girl does, no matter if she plays a "lolita" role....the 12 year old CHILD is not responsible for the actions of a grown man.....even if that adult "thinks" that the child is consenting. A 12 year old child CAN NOT consent to any sort of sexual relationship with an adult. Period. There is not a question in this whatsoever!!! We as a community establish the rules/laws we are to live by...and create the laws. The laws to protect children from adult predators are there for a reason. How damaged do you think these 12 year old girls will be when they grow older? When do they get a childhood? They don't because Joe took that away from them. He stole their childhood, he stole their innocence, and their ability to trust. The worst part is that children who experience this type of sexual trauma in their childhood frequently grow up to have the potential to do this to others as well... with a good intervention...hopefully these girls will be able to heal and have the best possible lives possible...and hopefully have productive and happy lives. My heart goes out to the families. And as far as Joe goes... I hope that he will someday come to admit his wrongs, and find a way to become a productive member of society. His career is over, and really his life will never be the same. He is a Megan's Law predator who can be listed on the internet, and the public, once he is released from prison, will have every right to know his every move for the rest of his life. I am so saddened to see someone who had such a bright opportunity for his life throw his entire life away....and pleased that at least someone finally listened to these poor children....shame on the Salem keizer school district for trying to cover this up. And finally, to all of my former Viking friends/family ..(North Salem High School) and my fellow Argo's.... Please take care of yourselves, and take this horrible event to heart...check how you are living your lives......PLEASE.... I don't want to see any of my other friends go through this.... there have been TOO many of us who I have seen in the headlines for not so wonderful or even horrendous things... please please take an inventory of your life and choose to live a life that you and all of us can have pride in.

Now that the sentencing is over, I hope the victims and their families, along with Joe?s wife and family, can find the strength to pull together and begin the long process of overcoming the pain and deception of yet another predator unable to control his desire for young girls. Joe Billera taught band to both of my daughters. He has a wonderful talent to teach music. If you have ever been to one of his concerts you would be amazed at the incredible music he was able to produce from such a young group of kids. It?s too bad that he, like an alcoholic, drug addict or someone with a gambling problem, was not able to understand his weakness and get help. When a trusted adult crosses the line, and uses his authority to control young children (especially a teacher) it shock?s us. As Houck parents were unaware of the solicitations that were going on right under our noses. We had absolutely no knowledge of what our children may have been subjected to in our ?No Tolerance? school system. I hope the Salem school district will step up to the plate and investigate how they dropped the ball on this one and accept some of the responsibility for these unfortunate circumstances.

This whole thing is so hard for me to believe, I live in the Portland area and I only knew Joe from my last two years at camp. I was absolutely devastated when I heard on the news this morning. I never knew anything like this had ever been an issue with him. He seemed so cool and normal. He just seemed like a good teacher. My heart goes out to all of you that have been affected by this.

My heart breaks especially for Joe's wife, a friend of mine, who not only has to deal with hurt, betrayal, but also has to gather up strength to raise 2 little ones without a father around. I know with God's grace, she'll get through this. Personally, I'm still in disbelief... Joe was not only a fellow college alumnus, a co-worker, but also a good friend who was always willing to help. Teaching along side of him, I saw his strengths, and like all of us, he had weaknesses. Whether small or big, we all SIN. It is the ugliness of sin that messes up lives. So if you must hate, hate sin, not the person. Only God has the power to judge, forgive, and heal those who are hurt by sin? and I know that God still loves Joe, regardless of this despicable crime. I encourage all of us to have compassion as well? to love even our enemies. Hateful words only make matters worse (think about Joe?s 2 young children who may read your words someday... Joe is still their dad). Joe grew up without a positive relationship with his father. Joe?s children need to grow up knowing that they are still loved by their dad, no matter what has happened. The best thing we can do is to continue to pray, to pray for the girls, their families, Joe?s family, and the entire Houck/ NSHS community?? for God to heal & give peace that will surpass all understanding.

My two daughters are involved in MIddle School Music programs. While some middle schoolers are into exploring their sexuality, many others are not. They're into games & fantasy books. Boys still have cooties. Innocent kids can easily be groomed to fill a predators' needs. If you've ever taken the time to investigate the damage done to abused children, and their families by sexual predators, you'd know that a twelve year sentence is far too little to pay. From a parents point of view, it's almost a slap in the face.

This girls are high schoolers NOW. But they started out as junior high students. All of his vicitms did. He was at least a 24 year old man who was preying on 11, 12, and 13 year olds. Middle schoolers, for all of their big talk, are still little kids. It's up to the adults in their life to keep that in perspective NOT the kids. We loved Joe. We still do. But I think it's true, what the prosecutor said. He truly was as good a sex offender as he was a teacher.

I was "best friends" with his little brother back in the day, and his wife worked at my local bank branch (she was smoking hot). I met him a few times, he seemed nice, never got touched by him though. It seems, now that he has been sentenced to 12.5 years, and pleaded guilty, that he did something. You know, it's odd, I just watched "Lolita" last night, and that movie definetly brings up questions of pedophilia, and who uses who, etc. If some of the rumors are true (he bought girls meals/clothes/movie tickets, etc.) it may be possible that the "victims" are complicit in these "crimes" as well. I mean, these are high schoolers, they know all about sexuality, they are not "helpless victims." It's not like they are elementary students or something. Middle schoolers are a bit different, but they are at least somewhat aware of their own sexual powers. Every 40 year old out there can get the idea out of their head that if you're under 18, you're an innocent little child. It's just not like that anymore. Basically, give the guy a break. He's a human too. True, he took advantage of his position and did inappropriate things with students, perhaps in a pattern that seems disturbing. But he's still a person, he's doing his time (every day of those 150 months, over 4500 days). When he gets out, I hope he can try to lead a normal life once again.

I'm too chicken to call and ask him, but this was a man who was too concerned about decency to let the colorguard wear Spandex.."It's just too reavealing"... He has to have been just sick about this, and I can't imagine him seeing any impropriety and not speaking up. Hey, and what the heck do Joe's actual classmates say about him? Joe Billera was hired to teach at the University of Oregon Summer Camp in recent years. Conveniently, he was put in charge of the dormitories. His inappropriate behavior of a sexual nature directed towards the high school girls was observed and commented on by numerous students during those summers. As a band parent, I learned about him only after my child had attended the camp for two summers. When I heard about Joe Billera's "overly friendly conduct," I chose not send my child back to camp for a third summer. We found another summer music camp instead. I figure if the kids at the U of O summer camp could deduce what Joe Billera was doing, then surely the other instructors MUST have had at least an inkling. Yet nothing was done to stop him. Joe Billera has been preying upon young girls for years. There is no telling how many of his victims have just not come forward but who will continue to be haunted by him for the rest of their lives.

I have been around Joe since he first started teaching at houck, I was in the first class he taught there. I remember many times my 8th grade year when I would walk in to the band room for class, and go to his office to talk to him, and he had students sitting on his lap, with his arms around them, so this doesn't surprise me, I actually have been expecting this. He was actually denied a teaching job at North High due to these allegations which where reported by other parents.

This recent news of Joseph Billera is disheartening, questionable, and unfortunate. However, this is a time for thoughtful discretion on all sides. Nothing is over until its over and checked out. Though extremely talented and gifted, it is not so hard to swallow the idea of this behavior being of truth from this man. I have worked along side Joe in the past with Argonauts and Northern Lights marching bands and he is a mass of musical elation and pride. HE LOVES teaching and loves a challenge. I looked up to him on many occasions in the past as did his students and peers. He may have the chance now to find himself and challenge what is to come and to challenge his mind into healthy behavior personally and PROFESSIONALLY! The teaching world can be a rough political ground almost daily. There are some parents out there that are out for themselves at the expense of their childs education experience. Lawsuits, quaffs, etc... And there are teachers that take advantage of the fact that they have a gift- to get to teach young minds. Some push things too far on a personal level. When it endangers people, than all has lost!! Music is something that I am a part of every day and I can't imagine not having it in my life. I hope that these accusations are false. However if not, then due crime is due time. We don't need anyone else to poison these children with hate, fear, guilt or sadness. That includes media, parents, teachers and educators. I went to high school and college with Mr. Billera. While my impression of him during those years was less than favorable, it would be his early teaching career that would solidify my very poor opinion of his character, For years, rumors of Mr. Billera's "friendliness" with students under his charge became commonplace - to the point where some parents began to notice and discuss the situation. This is truly unfortunate not only for the alleged victums and their families, but for the Salem-Keizer School District as well. Dispite his flaws and now this sad business that he finds himself, Mr. Billera IS a gifted musician and teacher.

Joe Billera was also my teacher at Houck Middle School and my instructor in marching band. I believe that Billera did commit the crimes due to inappropriate behavior he committed during sessions with students. I feel he should be punishable as far as the extent of the law so that other CHILDREN cannot be manipulated and abused by this pervert
